When considering whether or not to file a medical malpractice lawsuit, several things need to be addressed. First of all, medical malpractice suits can be very lengthy and expensive legal matters and you need to be confident that your claim meets the criteria needed in order to be filed. It is recommended that if you are considering filing a claim, you seek the advice of an experienced attorney who specializes in medical malpractice cases.

Medical malpractice occurs when a physician or other medical professional does or fails to do something which results in further injury or harm to the patient. This negligence is a partial basis for a medical malpractice claim but the standard of care given must also be evaluated.

Standard of care deals with the generally accepted method of care that other medical professionals would use in treating a case similar to yours. If you can establish that you did not receive the standard of care for your type of medical situation, you must then be able to show that the omission of that care caused further injury or harm and that the injury is directly related to the negligence.
